These terms explain how website projects, payments, cancellations, refunds and ownership are handled by Hussein Swaleh Design.

1. When these terms apply
These terms apply when you approve a quotation or proposal, pay a deposit or ask me to begin work. By paying a deposit, you confirm that you have read, understood and agreed to these terms and the relevant project proposal. A written proposal may include project-specific terms. If it conflicts with this page, the project-specific terms will apply to that project.
2. Scope and changes
The agreed proposal describes what is included in the project. Requests outside that scope may affect the price and timeline. I will explain any additional cost before carrying out extra work.
3. Payments
One-page website plans require an 80% deposit before work begins. The remaining 20% is due after final approval and before the website is launched or transferred.
A standard multi-page website normally requires a 50% deposit before work begins. The remaining payment schedule is confirmed in the project proposal. Payment schedules for redesigns and other custom work are also stated in the relevant proposal.
Work may be paused when an agreed payment is overdue. Domain names, paid software, premium assets and other third-party costs may need to be paid separately and in advance.
4. Cancellations and refunds
If you cancel before work begins, I will refund the amount paid after deducting any payment-processing charges and third-party costs that have already been committed and cannot be recovered.
If you cancel after work begins, the deposit is not automatically refundable in full. I will calculate the value of work already completed, time reasonably reserved for the project and any non-recoverable costs. Any remaining unearned balance will be refunded. If completed work exceeds the amount already paid, the outstanding amount remains due.
Completed custom work is not refundable after final approval or launch. If I am unable to complete a project that you have paid for, I will refund the unearned portion of your payment. Nothing in these terms limits a cancellation, refund or other consumer right that cannot legally be excluded.
5. Your responsibilities
You are responsible for providing accurate information, timely feedback and the text, photographs, logos or other materials needed for the project. You confirm that you own these materials or have permission to use them. Delays in content, feedback or approvals may move the delivery date.
6. Revisions and approval
Revisions included in the project are described in the proposal. Your approval confirms that you have reviewed the work and are satisfied for me to proceed. Changes requested after final approval or launch may be quoted separately.
7. Ownership and portfolio use
Once all project payments are complete, you may use the final website and project-specific deliverables supplied to you. I retain ownership of my pre-existing tools, methods, reusable code and working files. Third-party fonts, photographs, software and services remain subject to their own licences.
I may show the finished project in my portfolio, social media or marketing unless we agree in writing that the work is confidential.
8. Third-party services
Websites may rely on hosting providers, domain registrars, payment providers, form tools, plugins or other third-party services. Their availability, pricing and policies are outside my control. I will take reasonable care when selecting and configuring them, but I cannot guarantee uninterrupted operation by another provider.
9. Results and responsibility
I will provide the agreed services with reasonable care and skill. However, I cannot guarantee a particular search ranking, number of enquiries, sales figure or other commercial result. To the extent permitted by law, my total liability relating to a project will not exceed the fees you paid for that project.
10. Privacy
Information shared during an enquiry or project is handled as described in the Privacy Notice.
11. Governing law and questions
These terms are governed by the laws of Kenya. If a disagreement arises, we will first try to resolve it directly and in good faith. Any rights or remedies that cannot legally be excluded remain available.
